Regulated construction products

By the terms of placement on the market, construction products can be divided into two groups:

  • Construction products of the harmonised area, i.e. construction products placed on the market according to the provisions of Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OL 2011 L 88/5) (hereinafter referred to as Regulation (EU) No 305/2011 of the European Parliament and of the Council’), which are covered by harmonised technical specifications (harmonised European standards and European Assessment Documents, on the basis of which European Technical Assessments are issued).
  • Construction products of the non-harmonised area, i.e. construction products placed on the market according to the provisions of national legal acts (in the Republic of Lithuania, the Law of the Republic of Lithuania on Construction), which are not covered by harmonised technical specifications.
Assessment and verification of constancy of performance of construction products

The assessment and verification of constancy of performance of regulated construction products covered by harmonised technical specifications shall be performed in accordance with the systems and technical specifications for assessment and verification of constancy of performance specified in the List of Regulated Construction Products, according to the procedure established in Regulation (EU) No 305/2011 of the European Parliament and of the Council.

The assessment and verification of constancy of performance of regulated construction products not covered by harmonised technical specifications shall be performed in accordance with the systems and technical specifications for assessment and verification of constancy of performance specified in the List of Regulated Construction Products, in accordance with the procedure established by the Technical Construction Regulation STR 1.01.04:2015 ‘Assessment, verification, and declaration of constancy of performance of construction products not covered by harmonised technical specifications. Designation of testing laboratories and certification bodies. National technical assessments and designation and notification of technical assessment bodies’ (hereinafter referred to as ‘Technical Construction Regulation STR 1.01.04:2015’).

Declaration of performance

A manufacturer from a Member State of the European Union, a state that is a signatory of the Agreement on the European Economic Area, or Turkey, which places construction products on the market of the Republic of Lithuania, shall issue a declaration of performance on a construction product placed on or being made available on the market of the Republic of Lithuania (in the Lithuanian language) drawn up as provided for in the harmonised technical specification on the product according to the procedure established in Regulation (EU) No 305/2011 of the European Parliament and of the Council, or, if the product is not covered by a by harmonised technical specification, then a declaration of performance (in the Lithuanian language) drawn up according to the requirements of the Law of the Republic of Lithuania on Construction and Technical Construction Regulation STR 1.01.04:2015.

Functions of designated and notified bodies

Certificates of constancy of performance of construction products, certificates of conformity of the factory production control, and test reports according to the harmonised technical specifications indicated in the List of Regulated Construction Products shall be issued by notified bodies upon performing tasks of a third party in assessing and verifying constancy of performance of construction products.

Certificates of constancy of performance of construction products, certificates of conformity of the factory production control, and test reports according to the other technical specifications indicated in the List of Regulated Construction Products shall be issued by designated bodies upon performing tasks of a third party in assessing and verifying constancy of performance of construction products.
